User Privacy and Data Protection

SM2Communicate Ltd ("SM2C") is committed to protecting your privacy and complying with all applicable data protection laws, including the UK Data Protection Act 2018, the UK General Data Protection Regulation (UK GDPR), and the Privacy and Electronic Communications Regulations (PECR).

Our data protection policy is based on the following principles:

  • We recognise the need for user privacy and data protection legislation compliance
  • We understand we have a duty of care to our clients and partners
  • We only collect and process data that is necessary for the purposes described in this policy
  • We will never pass any client data to a third party unless we have a lawful basis to do so and appropriate safeguards in place
  • We endeavour to ensure that all our data is correct and up-to-date

Our Lawful Bases for Processing

We rely on different lawful bases depending on the context:

  • Contract: where we process personal data to deliver services to our clients under a signed Client Contract.
  • Legitimate interests: where we process data about prospects, website visitors, or business contacts to respond to enquiries, maintain business relationships, or improve our services, balanced against your rights.
  • Consent: specifically for email marketing and newsletters, where you have actively opted in, and for any non-essential cookies (see below).

Data Collection

We only collect identifiable personal data or information that is specifically and voluntarily provided by a visitor to our website. We receive limited identifiable information, such as name, title, company address, email address, and telephone numbers, from website visitors. Typically, identifying information is collected to:

  • Register for certain areas of the Site
  • Enquire for further information
  • Sign up to our mailing list
  • Distribute requested reference materials
  • Visitors are also able to send emails to us through the website. Their messages will contain the user's screen name and email address, as well as any additional information the user may wish to include in the message

This information is stored in our HubSpot customer database. The database enables SM2Communicate to provide you with any information you or we request.

We may also use this information to track activity on the Site, to have a better understanding of how visitors use the Site.

We may use your personal data for future email mailings, general correspondence and correspondence which may relate to you, where you have opted in. If you would rather not receive future marketing emails from us please inform us by email to hello@sm2communicate.co.uk.

How Long We Keep Your Data

  • Client contracts and records: kept for 6 years from the end of the engagement.
  • Marketing and newsletter contacts: reviewed after 2 years of inactivity, and removed or re-permissioned.
  • General enquiries with no ongoing relationship: kept for 12 months, then deleted unless you become a client or an active marketing contact.

International Transfers

Some of the tools we use to provide our services, including HubSpot, may store or process personal data outside the UK, including in the United States. Where this happens, we ensure appropriate safeguards are in place, such as the UK International Data Transfer Agreement (IDTA), the UK Addendum to the EU Standard Contractual Clauses, or reliance on an adequacy decision, so that your data remains protected to UK standards regardless of where it is processed.

Accuracy

Our privacy policy only applies to the collection of data and may change from time to time in line with legislation or industry developments. Any changes will be detailed on our website.

You have the right to request access to, correction of, or deletion of your personal data, to object to or restrict processing, and to request data portability where applicable. You can exercise these rights by emailing the address at the bottom of this page.

If you are dissatisfied with how we handle your data, you have the right to lodge a complaint with the Information Commissioner's Office (ICO) at www.ico.org.uk.

Contact Forms and Emails

If you contact us using the form on our contact page, the information you provide will be transferred to us via email, which will then be stored in our database.

Email Newsletter and Direct Marketing

If you sign up for our email newsletter, your email address will be stored in our HubSpot CRM database, which is accessed by our team and, where relevant, our chosen marketing services provider.

Where SM2C sends marketing emails on behalf of a client business, that client remains the primary party responsible for PECR compliance for that marketing (including consent and suppression records), and SM2C is responsible for ensuring the technical and content requirements of any emails we send at their instruction (accurate sender identification, working unsubscribe links, honouring opt-outs promptly).

You can request removal of your email address from any of our mailing lists at any time. A link to unsubscribe will be at the foot of every newsletter, or you can contact us directly at hello@sm2communicate.co.uk.

Cookies and Site Visitor Tracking

We use cookies and similar technologies on the Site. Some are strictly necessary for the Site to function; others (such as analytics or tracking cookies) are non-essential and are only set with your active consent, gathered via the cookie banner shown when you first visit the Site.

You can change your preferences at any time using the cookie settings link on the Site, or by adjusting your browser settings to block or delete cookies, though this may affect how parts of the Site function.

We do not use cookies to identify you individually; they help us understand how the Site is used so we can improve it.

Market Research

We do not disclose information about your individual visits to the Site, or information which identifies you, to any third parties unless we have your prior consent or unless required by law, local regulators, or law enforcement.

Certain functions such as hosting, storage, and disaster recovery may be provided by third parties. Where we do so, we enter into a written agreement with that provider reflecting our commitments under this Privacy Policy.

Business Transition and Referrals 

Following the acquisition of certain goodwill, client relationships, and online content from Socius Projects, SM2Communicate Ltd (“SM2C”) has assumed responsibility for maintaining continuity of client services and data previously collected by Socius Projects.
All personal data previously held by Socius Projects is now controlled by SM2Communicate Ltd, registered in England (Company No. 7907574), in accordance with this Privacy Policy and the UK General Data Protection Regulation (UK GDPR).

If you previously engaged with Socius Projects, SM2C may continue to process your personal data under the lawful basis of legitimate interests to ensure continuity of service, maintain project records, and provide relevant follow-up communication.
You retain all data subject rights under the UK GDPR, including the right to access, rectify, erase, or restrict processing of your personal data. You can exercise these rights by emailing the address at the bottom of this page.

SM2C also operates professional referral and partnership arrangements with trusted independent businesses within the property, surveying, and project management sectors.
Where a referral involves personal data (for example, client names, contact details, or project information necessary for an introduction), such data will be shared only to the extent necessary to facilitate that introduction and only where a lawful basis applies — usually legitimate interests or your explicit consent.
All referral partners act as independent data controllers for any personal data they subsequently process and are responsible for their own GDPR compliance. SM2C ensures appropriate contractual and confidentiality safeguards are in place with all such partners.

SM2C will never sell, lease, or disclose personal data to any third party for marketing or unrelated purposes.

Security

It is our policy to virus-check documents and files before they are posted on this Site. However, we cannot guarantee that documents or files downloaded from this Site will be free from viruses, and we do not accept responsibility for any damage or loss caused by any virus. For your own protection, please use virus-checking software when using this Site.

You must not post or provide to us via this Site any document or file you believe may contain a virus.

No data transmission can be guaranteed 100% secure. While we strive to protect your personal information, we cannot warrant the security of information you transmit to us, and you do so at your own risk. You remain responsible for the security of your own computer at all times.

Data Breaches

In line with ICO data protection regulations, we will report any personal data breach likely to result in a risk to individuals' rights and freedoms to the ICO within 72 hours of becoming aware of it. Where a breach is likely to result in a high risk to affected individuals, we will also notify those individuals directly without undue delay.
